1. Service Description

Podium AI is a mobile application that provides AI-powered personal style consultancy services. The Application offers the following services:

• AI Style Consultancy: Outfit recommendations based on weather and your wardrobe
• Wardrobe Management: Digitally storing and categorizing your clothing
• Virtual Try-On: Simulating how clothing would look on you using artificial intelligence
• Style Critique: AI analysis and evaluation of your outfit photos
• AI Chat: Text-based communication with a style consultant

2. Account Creation and Security

• You must create an account to use the Application.
• You are responsible for ensuring that the information you provide during account creation is accurate and up to date.
• You are responsible for the security of your account and all activities performed under your account.
• You must notify us immediately if you detect unauthorized access to your account.
• Users under the age of 13 may not use the Application.

3. User Responsibilities

By using the Application, you agree to comply with the following rules:

• Use the Application only for lawful purposes and in accordance with these terms
• Not upload content that infringes on the rights of others
• Not share inappropriate, obscene, or illegal content
• Not engage in activities that could compromise the security or disrupt the operation of the Application
• Not use the Application for reverse engineering, source code extraction, or copying purposes
• Not access the Application through automated systems, bots, or similar tools

4. Subscription and Payment Terms

4.1 Membership Tiers

The Application offers three membership tiers:

• Free: Limited access to basic features
• Pro: Extended features and higher usage limits
• Elite: Full access to all features and maximum usage limits

4.2 Payment

• Paid subscriptions are processed through the Apple App Store or Google Play Store.
• Subscription fees are charged weekly or monthly based on your selected plan.
• Payment is debited from your store account upon purchase confirmation.
• Podium AI does not directly collect, process, or store your payment information.

4.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Renewal charges are debited from your account within 24 hours before the period ends.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through the subscription settings of the relevant store (App Store / Play Store).
• Cancellation takes effect at the end of the current billing period; you retain access to premium features for the remaining duration.
• Refund requests are subject to Apple or Google's refund policies.

5. Intellectual Property

5.1 Podium AI's Rights

• The Application, its design, logos, software, content, and all related intellectual property rights belong to Podium AI.
• The AI models, algorithms, and technologies within the Application are trade secrets of Podium AI.
• These terms grant you the right to use the Application for personal, non-commercial purposes only; they do not transfer ownership rights.

5.2 User Content

• You retain ownership rights over photos and content you upload to the Application.
• By uploading your content, you grant Podium AI a license to process, store, and use this content for AI analysis and service delivery purposes.
• This license terminates when you delete your account.

6. AI-Generated Content

• Style suggestions, outfit scores, and AI responses provided by the Application are for informational purposes only.
• Visual and text content generated by AI (virtual try-on images, style suggestions, etc.) are not definitive or guaranteed results.
• Virtual try-on images are simulations and may differ from actual appearance.

7. Limitation of Liability

• Podium AI is not responsible for direct or indirect damages arising from decisions made based on AI recommendations.
• We are not responsible for access issues arising from technical failures, server outages, or disruptions in third-party services.
• Podium AI's total liability shall not exceed the amount you paid for the Application in the preceding 12 months.
• Podium AI reserves the right to modify or remove any feature of the Application without prior notice.

8. Account Termination

8.1 By the User

• You may delete your account at any time from within the Application or by sending an email to info@apppodium.com.
• Account deletion is permanent; all your data, photos, and wardrobe records will be irreversibly deleted.

8.2 By Podium AI

• In the event of a violation of these terms, your account may be suspended or terminated without prior notice.
• If illegal activities or misuse are detected, the account may be immediately closed.
• In the event of termination, whether a refund will be issued for the remaining subscription period will be evaluated on a case-by-case basis.

9. Modifications

• Podium AI reserves the right to update these Terms of Use at any time.
• In-app notifications will be sent for significant changes.
• Your continued use of the Application after changes constitutes acceptance of the updated terms.
• You can always access the current terms on this page.

10. Governing Law and Dispute Resolution

• These Terms of Use are governed by the laws of the Republic of Turkey.
• Istanbul Courts and Enforcement Offices have jurisdiction over any disputes arising from these terms.
• In the event of a dispute, amicable resolution methods will be sought first.
